A wrongful-death lawsuit filed in San Francisco County Superior Court alleges that ChatGPT, a product of OpenAI, gave a 19-year-old UC Merced student advice that led to his death. The complaint alleges ChatGPT coached him to mix kratom with the prescription drug Xanax and failed to warn him the combination could be fatal. The student, Sam Nelson, died of an accidental overdose in May 2025. The family's claims include defective product design, failure to warn, negligence, wrongful death, and unlawful presentation as a licensed health practitioner, and they ask the court to pause OpenAI's ChatGPT Health feature. The allegations are unproven, the case is at the complaint stage, and no court has found OpenAI or Sam Altman liable.
